JUSTICE IN ISLAM (AN INTRODUCTION)

Assalam oalaikum,

We are all well-versed with Allah (swt)’s Trait of being Merciful as it has been oft mentioned in the Holy Quran. One of the beautiful names of Allah (swt) Al-Rahim also means Merciful. In a hadith (Tirmidhi) Abdullah bin Umro-bin Aas (ra) reported that Prophet Mohammad (saw) said, ‘Those who have mercy will receive the mercy of the Most Merciful. Have mercy on those who are on earth and the One in Heavens will have mercy on you’. So Allah (swt) is All-Merciful and He also encourages us to show mercy towards one another.

Likewise, another Trait of Allah (swt) is of being All- Just, as is evident by His name Al-Adl, which means the All-Just. Allah (swt) is Just in His Creation, Legislation, and Retaliation. Allah (swt) says in a hadith Qudsi, ‘I have forbidden injustice for Myself and have made it forbidden amongst you, so do not oppress one another’. The Holy Quran has given us the message of justice and peace.
So just like Allah (swt) is Merciful and encourages us to show mercy towards one another, likewise Allah (swt) who is All-Just, commands us to behave in a just and fair way towards one another.

The Holy Quran teaches us how to establish justice in the society through its numerous verses, which I shall discuss in detail in my subsequent posts.
It is only when justice prevails in a society that it gets rid of all kinds of oppressions, everybody gets what is rightfully theirs and nobody is wronged. The Divine Islamic law is comprehensive and it encompasses all the aspects of a person’s life. Just like Islam, the Islamic law is also meant for all the times and not for any particular era. It is not meant to be transformed or modified to make adjustments with any kind of transformation in the ever-changing, man-made society. On the contrary, the followers of Islam are expected to follow the Islamic law despite the socio- economical, political, scientific, technological or environmental change. In other words, people need to adjust according to the Islamic law rather than trying to make changes in it because the Islamic law is Divine and nobody has the right to meddle in the Divine matters.

The Islamic law is the Command of Allah (swt) and it is meant to be implemented for the betterment for the society, by and large. In order to benefit from the Islamic law, which is based on equality and justice, first and foremost, we need to implement it in our lives and follow it practically. Mere theoretical knowledge about the Islamic law will be of no good if we do not actually put it into practice. Hence, in order to get justice we should not hesitate to approach the Islamic courts which have lawyers/attorneys trained in the Islamic law.
